oreign-relatedcommercialtrialshaveattractedincreasingsocialattentionanddemand.Locatedintheintersectionofthe“BeltandRoad”,JiangsuProvinceboastsfrequentcross-borderinvestmentanddynamicforeigntrade.Moreover,itsamountofforeigncapitalactuallyusedhasrankedthefirstinthecountryformanyyears,anditstotalimportandexportofgoodshasremainedthesecondinthecountryfor16consecutiveyears.China(Jiangsu)PilotFreeTradeZonehasalsobeencompleted.Correspondingly,courtsofJiangsuProvincehavealsotriedalargenumberofforeign-relatedcommercialcases,aswellascasesinvolvingHongKong,MacaoandTaiwan.Inrecentyears,undertheleadershipoftheprovincialpartycommitteeandthesupervisionoftheNationalPeople’sCongress,undertheguidanceoftheSupremePeople’sCourtandwiththesupportofallwalksoflife,courtsatalllevelsinJiangsuProvincehaveactivelyrespondedtonewsituationsandnewproblemsintheprocessofcomprehensiveopeningup,implementedthebestqualitystrategyoftrial,gavefullplaytothefunctionofforeign-relatedcommercialtrial,soastoguideandstandardizeinvestmentandtradeactivities,equallyprotectthelegitimaterightsandinterestsofChineseandforeignlitigants,andmakeactiveeffortstocreatealegal,internationalandconvenientbusinessenvironment.Alloftheseeffortshaveachievednewreturns.Tothisend,wereleasedthiswhitepaperonforeign-relatedcommercialtrialsbycourtsofJiangsuProvince,showingtherelevantworkofcourtsofJiangsuProvinceinservingandensuringthenewpatternofcomprehensiveopeningupinJiangsu,andmakingtheoreticalexplorationandpracticalprospectforfurtherpromotingforeign-relatedcommercialtrials.

I.BasicSituationandCharacteristicsofForeign-RelatedCommercialTrialsbyCourtsofJiangsuProvince

I)Basicsituationofforeign-relatedcommercialcases

1.Thenumberofforeign-relatedcommercialcasesisgenerallybalanced,showingasteadyupwardtrend.

From2014totheendofOctober2019,courtsofJiangsuProvincehaveacceptedatotalof7,548foreign-relatedcommercialcasesoffirstinstance(including3,615casesand3,933casesinvolvingHongKong,MacaoandTaiwan),833foreign-relatedcommercialcasesofsecondinstance(including481foreign-relatedcasesand352casesinvolvingHongKong,MacaoandTaiwan),andthenumberofcasesacceptedrosesteadily(seeChart1).Atotalof8,107foreign-relatedcommercialcaseswereconcluded.Inaddition,from2014totheendofOctober2019,courtsofJiangsuProvincealsohandled6,286casesofjudicialassistance(including113casesofrecognitionandenforcementofforeignjudgmentsandarbitralawards,aswellasjudgmentsandarbitralawardsofHongKong,MacaoandTaiwancourts),tried6,788arbitrationjudicialreviewcases.

2.Thenumberofforeign-relatedcommercialcasesisunevenlydistributedinregions,withgreatregionaldifferences.

Thenumberofforeign-relatedcommercialcasesacceptedbycourtsinvariouspartsofJiangsuisquitedifferent,andthedistributionisextremelyuneven.Suzhou,NanjingandWuxiwereamongthetopthreeinthenumberofcasesacceptedbythecourts,accountingfor64.96oftheforeign-relatedcommercialcasesbycourtsofJiangsuProvince.Thenumberofforeign-relatedcommercialcasesreflectshowdynamictheeconomicexchangesinaregionare.Forinstance,Suzhou,asamodelofJiangsu’sexport-orientedeconomy,isdirectlycharacterizedbythelargenumberofforeign-relatedcommercialcasesandtheheavytaskofforeign-relatedcommercialtrials.

3.Diversifieddisputesandrelativelyconcentratedcausesofaction

Foreign-relatedcommercialcasesacceptedbycourtsofJiangsuProvinceinvolve210specificcausesofaction,mainlyincludingloancontracts,contractforinternationalsaleofgoods,importandexportagencycontracts,equitytransferdisputes,companydissolutiondisputes,lettersofcreditdisputes,etc.,coveringcross-bordertrade,investment,financeandotherfields.ThediversificationofdisputetypesreflectsthecontinuousexpansionofJiangsu’seconomicopeningtotheoutsideworld,thecontinuousexpansionofcross-borderinvestmentfieldsandthecontinuousincreaseinforeigntradeandeconomiccooperation.Inordertocorrectlytrydifferenttypesofforeign-relatedcommercialcases,itisnecessarynotonlytobefamiliarwiththelawsandregulationsinrelevantfields,butalsotohaveathoroughunderstandingoftheprofessionalknowledgeandtradingpracticesofvariousindustries,whichallincreasethetrialdifficulty.Althoughtherearevarioustypesofforeign-relatedcommercialcases,thecausesarerelativelyconcentrated.Disputessuchasinternationalsaleofgoods,financialloans,equitytransferandfinanceleasehavealwaysaccountedforalargeproportionofforeign-relatedcommercialcases.
