rommorethan100countriesandregionssuchastheUnitedStates,Britain,Japan,SouthKorea,Singapore,BritishVirginIslands,andmorethanhalfofthecasesinvolvetraditionaltradingpartnerssuchastheUnitedStates,BritainandSingapore,whichimpliesthattheintegrationofJiangsuandtheworldeconomyisdeepeningincreasingly.ThetotalnumberofcommercialcasesinvolvingHongKong,MacaoandTaiwanacceptedbycourtsofJiangsuProvinceis4,285,accountingfor51.0ofthetotalnumberofcasesinvolvingforeignregions,HongKong,MacaoandTaiwan.CourtsofJiangsuProvincehaveaccepted2,181commercialdisputesinvolvingTaiwan,accountingfor26ofthetotalnumberofcommercialcasesinvolvingforeignregions,HongKong,MacaoandTaiwan.JiangsuisoneoftheregionswhereTaiwanesebusinessmeninvestthemostinthemainlandandTaiwan-fundedenterprisesaremostconcentrated.TheexchangesandcooperationbetweenJiangsuandTaiwaninvariousfieldscontinuetodevelop,withcloseeconomicandtraderelationshipaswellasfrequentinvestmentandtrade.Therefore,courtsofJiangsuProvincehavealsoacceptedalargernumberofTaiwan-relatedcases.

5.Thetotalamountofforeign-relatedcommercialcasesisrelativelylarge,withobviousdifferencesinindividualcases

Inthepastsixyears,theamountofforeign-relatedcommercialcasesacceptedbycourtsofJiangsuProvincehasexceeded80billionyuan.From2014totheendofOctober2019,theaverageamountofforeign-relatedcommercialcasesacceptedare5,783,000yuan,7,647,300yuan,10,513,800yuan,8,283,100yuan,10,623,200yuanand14,487,000yuanrespectively,revealinganobviousupwardtrend.Thehighestamountofcaseis2.6billionyuan,andthelowestamountisonlytensofthousandsyuan,showingahugedisparitybetweencases.Theincreaseinthetotalamountofforeign-relatedcommercialcasesreflects,toacertainextent,theincreaseofcross-borderinvestmentandtradeactivitiesofJiangsuandtheincreasingjudicialdemandfordisputeresolution.

6.Thetrialqualityofforeign-relatedcommercialcasesisgoodandtherateofretrialorjudgmentamendmentislow.

Inthepastsixyears,thetotalnumberofforeign-relatedcommercialcasesdecidedbycourtsofJiangsuProvinceinthefirstinstancewas3,732,accountingfor49.45ofthetotalnumberofcases.Thenumberofmediatedorcancelledcaseswas3363,accountingfor44.56.Inthepastsixyears,therateofmediatedorcancelledcasesoffirst-instanceforeign-relatedcommercialcaseshasremainedbasicallystable.Therateofobeyingthetrialwithoutappealoftheforeign-relatedcommercialtrialinthefirstinstanceis82.9,theappealrateis11.04,andtherateofretrialorjudgmentamendmentinthesecondinstanceis0.7,withthequalityoftrialbeinggenerallygood.Duetofactorssuchasoverseasdelivery,thetrialperiodisrelativelylong,withanaveragetrialperiodof257daysforforeign-relatedcommercialcasesinthepastsixyears.

OpeningupcharacterizesthedevelopmentofJiangsu.Foreign-relatedcommercialcasesbycourtsofJiangsuProvincealsomanifestsomenewfeaturesthatarerelatedtothehighlevelofJiangsu’sopeneconomy.

1.Thenumberofcasesinvolvingcountriesalongthe“BeltandRoad”routehasincreasedsignificantly

Afterthe“BeltandRoad”wasputforward,Jiangsu,asthejunctionofthe“BeltandRoad”,hasexchangedmoreandmorefrequentlywithcountriesalongtherouteinpersonnelandtrade,thereforefollowedbymoreandmorecommercialdisputes.Accordingtostatistics,inthepastsixyears,morethanhalfoftheforeign-relatedcommercialcasestriedbycourtsofJiangsuProvinceinvolvedcountriesalongthe“BeltandRoad”route,whilethetotalnumberofcommercialcasesinvolvingcountriesalongthe“BeltandRoad”routeaccountedforabout30ofthetotalnumberofforeign-relatedcommercialcases(exceptthoseinvolvingHongKong,MacaoandTaiwan)triedbycourtsofJiangsuProvince.

2.Newtypesofcasesareconstantlyemerging

Intheforeign-relatedcommercialtrialsofcourtsofJiangsuProvince,newtypesofcasessuchasinternationalsyndicatedloans,fraudinletterofcredit,fraudinindependentguarantee,financelease,equityrepurchase,andenterprisevaluationadjustmentagreementsareontheincrease,andtheoveralllitigationamountisrelativelyhigh.Thisreflectsfromthesidethatwiththeimplementationofhigh-leveltradeandinvestmentliberalizationandfacilitationpolicies,thefinancialsectorhasbecomeincreasinglyopenandinnovative.

3.Theproceduralproblemsinforeign-relatedcommercialcasesareoutstanding

Ingeneral,foreign-relatedcommercialcasespresentproceduralproblemssuchasdifficultyinfindingoutthefacts,applicationofforeignlawsandserviceinforeigncases.Thelongtrialperiodofforeign-relatedcommercialcasesisdetrimentaltotimelyandefficientresolutionofdisputesandsafeguardingthelegitimaterightsandinterestsofthelitigants.
