ConsideringthelocationofJiangsu,theintersectionofthe“BeltandRoad”,courtsofJiangsuProvincerespondedpositivelytothejudicialneedsofthe“BeltandRoad”constructionandcreatedafair,transparentandpredictablebusinessenvironmentundertheruleoflaw.First,courtsofJiangsuProvincehaveactivelysteppedupnewspublicity.Theprovincialcourtheldapressconferenceontheconstructionoftheserviceandsafeguardforthe“BeltandRoad”toinformthemainpracticesofcourtsofJiangsuProvinceandtomaketentypicalcasespubic.Second,theinvestigationandstudyofforeign-relatedcommercialdisputeshavebeenvigorouslystrengthened.Inrecentyears,courtsofJiangsuProvincehavecompletedanumberofkeyresearchprojectsofprovincialsocietiesandcourts,including“StudyonLegalIssuesofIndependentGuarantees”and“StudyonApplicationofLawstoStopPaymentinFraudinLetterofCredit”.InPeople’sJudicature,thearticle“CourtsofJiangsuProvinceStrivestoEnhancetheJudicialCredibilityofForeign-relatedCommercialTrials,ServingandGuaranteeingtheConstructionofthe‘BeltandRoad’”waspublished,summarizingthepracticalexplorationofJiangsuCourt’sserviceandsafeguardofthe“BeltandRoad”construction,andsummingupthejudicialrulesystem.Third,relevantjudicialopinionsarereleased.CourtsofJiangsuProvinceatalllevelshavefoundtherightcombinationandlaunchedspecificmeasuresforserviceandsafeguard.Theprovincialcourtissuedthe“ImplementationOpinionsonElaboratingHigh-qualityJudicialServicesandSafeguardingJiangsu’sHigh-qualityDevelopmentattheFrontLine”,activelyescortingthe“BeltandRoad”construction.TheIntermediatePeople’sCourtofLianyungangCitypublished“TwelveOpinionsontheConstructionofPilotZoneintheCoreAreaofEscortthe‘BeltandRoad’Junction”,whichwasselectedbyPeople’sCourtDailyasoneofthesixtypicalmeasuresoflocalcourttoserveandsafeguardthe“BeltandRoad”construction.TheIntermediatePeople’sCourtofLianyungangCityhassetupthecountry’sfirstthe“BeltandRoad”circuitcourt,andhassigneda“FrameworkAgreementonJudicialCooperationinServiceGuaranteeforServiceandSafeguardoftheConstructionofNewAsia-EuropeLandandSeaTransportCorridor”withtheintermediatepeople’scourtsandmaritimecourtsof21prefecture-levelcitiesalongthe“BeltandRoad”inandoutsideJiangsuProvince,includingNanjingandSuzhou.
III)Innovatethejudicialmechanism,enhancethejudicialcredibilityofforeign-relatedcommercialtrialsCourtsofJiangsuProvincehavestrengthenedthemodernizationofforeign-relatedcommercialjudicialcapacityincombinationwiththeactualworkofforeign-relatedcommercialtrials.First,waystoascertainforeignlawshavebeenexpandedactively.TheprovincialcourthassetupanexpertdatabaseforascertainingforeignlawsforcourtsofJiangsuProvinceandinvitedmorethan30domesticandforeignlegalexpertstoserveasforeignlawexpertstohelpthepeople’scourtsascertainandapplyforeignlaws.Ithasalsoformulatedthe“MeasuresfortheAdministrationofExpertsDatabaseforAscertainingForeignLaws(Trial)”toregulatetheselectionanddeployofforeignlawidentificationexperts.Second,adiversifieddisputeresolutionmechanismhasbeenstudiedandestablished.InordertobetterpromotetheconstructionofservicedemonstrationareafortransferandagglomerationofTaiwan-fundedenterpriseindustryinHuaianCityandstrengthenconstructionofcross-straitindustrialcooperationpilotarea,courtsinHuaianCityandKunshanCityhaveimprovedthetrialmechanismtoprovidehigh-qualityandefficientjudicialserviceguaranteeforTaiwancompatriots.In2018,HuaianIntermediatePeople’sCourtandtheHuaianMunicipalTaiwanAffairsOfficejointlyformulatedandissuedthe“ImplementationOpinionsonStrengtheningtheTransferofAppealsandMediationinDisputesRelatingtoTaiwan”andsetuptheTransferringOfficeofAppealsandMediationtoformanoverallcooperationforce.ThePeople’sCourtofKunshanCity,thelocalTaiwanAffairsOfficeandtheTaiwanAssociationjointlysignedthe“OpinionsonStrengtheningMediationofTaiwan-relatedCases”andselected30speciallyinvitedmediatorstoparticipateinresolvingdisputesinvolvingTaiwanbusinessmen.Therateofmediationorcancellationofcas
