apacityandleadingdevelopmentinthenewhistoricalpositionandtoleadthecountryintheconstructionoftheruleoflaw.TheruleoflawshallbeactuallymadeanimportantsymbolofJiangsu’sdevelopmentofcorecompetitiveness.ThisrequirescourtsofJiangsuProvincetofindastartingpointfortheirwork,respondeffectivelytothenewrequirementsofmarketinnovationanddevelopmentinthefreetradezone,givefullplaytotheroleofjudicialguaranteeandguidance,ensuretheeffectiveimplementationoftherules,andconsolidatetheachievementsofreform.Theyshouldestablishthejudicialconceptofagreatcountry,clarifytherulesofadjudication,properlyresolvedisputesinaccordancewiththelaw,andequallyprotectthelegitimaterightsandinterestsofChineseandforeignlitigants.

II)Deepeningreformandopeningupinanall-roundwayposenewchallengestoforeign-relatedcommercialtrials

AsChinaimplementsahigh-leveltradeandinvestmentliberalizationandfacilitationpolicy,continuestorelaxmarketaccessandupgradethelevelofinvestmentliberalization,andgraduallyimplementsvariousreformmeasures,newsituationsandnewproblemswillcontinuetoemerge.Forexample,thenegativelistmanagementsystemforforeigninvestmenthaschangedtheexaminationandapprovalsystemtothefilingsystemfortheestablishment,equitytransferanddissolutionofforeign-fundedenterprises,thusimprovingtheconvenienceofforeigninvestment.TheForeignInvestmentLawwillalsoreplacethe“ThreeLawsonForeignInvestment”.Thepeople’scourthastotimelyadjustthelegalbasis,coordinatetheconnectionbetweenthelawandtheoriginaljudicialinterpretation,andcoordinatethejudicialreviewandadministrativesupervisionofthetransactionsinvolvedinthecasewhentryingcasessuchasconfirmationofshareholderidentityandequitytransfercontracts.

III)Newindustries,newformatsandnewmodelshaveputforwardnewtopicsforforeign-relatedcommercialtrials

Newindustries,newformatsandnewmodels,basedonadvancedmanufacturing,Internetplus,innovationandentrepreneurship,cross-bordercomprehensivemanagementandother“ThreeNew”activities,aredevelopingrapidlyinChina.Whileprovidingconvenienceandoptimizingtheallocationofresources,theyalsobringproblemssuchasdisorderlycompetitionandcreditmoralrisks.Forinstance,arbitrationofP2PInternetisaninnovationinarbitrationininternetplus.Inpractice,Internetplusbringsaboutproblemssuchasharmingtherightsandinterestsofordinaryconsumers,takinglendingasabusinesswithoutalicense,chargingultra-highinterestindisguisedform,andevensomecasesbeingsuspectedof“traploan”,whichnotonlyhavedamagedthehealthydevelopmentofarbitration,butalsodamagedthejudicialcredibilityofthepeople’scourt.

IV)TheopeningofNanjingMaritimeCourtopensnewfieldsforforeign-relatedcommercialtrials

NanjingMaritimeCourtwillbegintoperformitsstatutorydutiesonDecember4,2019.Maritimetrialisabrand-newfieldforcourtsofJiangsuProvince.Themaritimecourtsareattheforefrontwhenopeninguptotheoutsideworld.Theyarerelatedtothevitalinterestsofthemasses,themarinerightsandinterestsofthecountryandthehighlevelofopeninguptotheoutsideworld.Maritimetrialsarecharacterizedbyvariousforeign-relatedfactors,strongprofessionalism,complicatedlegalrelations,diversifiedapplicationoflaws,andgreatinternationalinfluence.Inparticular,manycasesrequiretheapplicationofinternationaltreatiesandrules,whichputsforwardhigherrequirementsonthequalityandabilityofmaritimejudges.Jiangsuisamajorprovinceofmarineandshipping.TherearealargenumberofmaritimecaseswithdiversifiedtypesofcasesinJiangsuProvince.Difficultandcomplicatedcaseswillemergecontinuously.

IV.OutlookofForeign-RelatedCommercialTrialsbyCourtsofJiangsuProvince

Facingthenewsituation,theforeign-relatedcommercialtrialteamofcourtsofJiangsuProvincemustfirmlyestablishtheoverallsituationawareness,strengthenthemissionresponsibility,givefullplaytothetrialfunctionwithahighsenseofresponsibilityandmission,comprehensivelydeepenthebestqualitystrategyoftrial,andprovideasolidlegalguaranteefortheimplementationofthenationalmajorstrategyandJiangsu’shigh-qualitydevelopmentintheforefrontofthecountry.

I)Improvethepoliticalstance,strengthenthesenseofmissionandresponsibility

Chinaisnowinanimportantperiodofpromotingthereformandopeningupinthenewera.Theopeneconomyisdevelopingindepthandtheruleoflawisadvancinginanall-roundway.Foreign-relatedcommercialtrialofthepeople’scourtshallapplyinternationaltreatiesandinternationalpractices,equallyprotectthelegitimaterightsandinterestsofChineseandforeignlitigants,andcreateaninternationalfirst-classbusinessenvironment.Atpresent,theinternationaleconomicandpoliticalstructurehasbeenprofoundlyadjusted,andforeign-relatedcommercialtrialsalsoshoulderspecialfunctionsofsafeguardingnationalsovereignty,securityanddevelopmentinterests.Tocreateafairandjustlegalenvironmentdependsonthepeople’scourthearingcross-borderdisputesininfrastructureconstruction,economicandtradeexchanges,industrialinvestment,cargotransportationandotherfieldsinafairandefficientmanner,providinghigh-qualityforeign-relatedcommercialtrialtoserveandsafeguardthehighqualityofreformandopeningup.
